General Terms and Conditions for Sale, Delivery and Courses

The business relationship between the customer (Purchaser) and BEE Medic GmbH Schweiz (Seller) and/or BEE Medic GmbH Germany (Seller), both with brand name EEGInfo, shall exclusively be governed by the terms and conditions for sale and delivery as provided below.

1. Order and Liability
Orders shall be placed in writing (e-Mail, fax or letter).
Contracts are closed with:
a) entry of the order by the Purchaser; or
b) sending of an acceptance of order by us; or
c) delivery of our goods or service.

2. Prices
The prices of our goods and service are subject to the US$. They can be adjusted anytime without advance notice. Price errors are excepted. For errors in calculation, writing and/or pictures we reserve subsequent credits. As far as not agreed upon in writing otherwise, the prices for our goods, services and deliveries are in accordance with those listed on our internet page. With the appearance of the new prices on our internet pages all other offers and prices are invalid. Not included are the costs for postage and packaging and customs and VAT.

3. Terms for Payment and Delay of Payment
Until complete payment, the goods are property of the company Bee Medic GmbH.
Unless not agreed upon otherwise, our invoices shall be paid net within 30 days after date of the invoice.
If Purchaser delays payment we are entitled to demand payment of interest for delay and/or reminder charges. The interests for delay are subject to the prime rate of the European Central Bank and exceed it by 5%. In case a higher damage caused by delay results verifiably for us, we are entitled to claim this damage.
In special cases we deliver against cash in advance only.
Part payments or payment in installments are not accepted by us.

4. Right of Withdrawal
We are entitled to withdraw from a contract with immediate effect and not to supply goods and/or render services if:
a) they are to be used for unsound, illegal or immoral purposes.
b) if there is justifiable doubt on the ability and/or willingness of Purchaser to pay.

5. Execution
Our products are basically shipped with postal service. The order is considered to be executed at the place where it is handed over to the postal service (place of delivery). A transport insurance is effected only on behalf of a written request by Purchaser and must be paid by Purchaser. We do not deliver to PO boxes.

6. Terms of Delivery and Deadlines
The delivery (i.e. handover of the goods to the postal service) is accomplished as far as possible within 3 work days after receipt of the order. In case the goods are not in stock, we ship them as soon as possible, after we have received the delivery. We are not liable for delays in posting or transportation.

7. Defects
Purchaser shall inspect the goods immediately after receipt with regard to completeness and defects and notify us about these within 3 days.
If this does not occur, the delivery is considered to be agreed to and accepted.
We are not liable for defects resulting from transportation or inappropriate usage.

8. Limitation of Liability
In case of defects for which we are liable, our liability is restricted to compensation delivery. The faulty product is to be returned to us immediately.
On our internet page we explicitly state that our products may be used by persons especially trained on their use only. Purchaser takes responsibility for adherence to this clause, we do not verify this.
For all damage and indemnity claims that result out of non-observance, we are not responsible.
Furthermore, every liability for damages that exceeds the provisions quoted above, especially for lost profits and useless expenditures of the Purchaser, is not accepted within the allowed legal frame.

9. Data Security
Purchaser agrees to the circulation of his data within consolidated companies.
Purchaser shall treat his access data as confidential and shall not transfer them to third persons. We do not assume liability for damage resulting from misuse.

10. VAT, Customs and Payment
All prices on the EEG Info online shop exclude VAT for Swiss and EU customers. Swiss/EU customers are required to pay VAT at the prevailing rate on all online orders unless a valid VAT ID is provided during the transaction. If a valid VAT ID is provided, then VAT will be zero rated.

Within the EU VAT is charged at 19% for all online purchases (except for books at 7%) because deliveries within the EU are made by BEE Medic GmbH - Germany, registered and based in Germany, where 19% and 7% are the standard rates of VAT.

For orders within Switzerland VAT is charged at 7,6% for all online purchases (except for books at 2,4%) because deliveries within Switzerland are made by BEE Medic GmbH - Switzerland, registered and based in Switzerland.

VAT is normally not charged on orders placed outside of the EU and Switzerland. For deliveries outside of the EU/Switzerland: Please note that when ordering from us, you are considered the importer and must comply with all laws. You may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you. We have no control over these charges and cannot predict what they may be.

We prefer payment by wire transfer which is convenient when used in combination with the IBAN number. 

11. Courses

General

Our terms and conditions are applicable to all courses offered by BEE Medic GmbH. In the following BEE Medic GmbH is called course organizer. Trainings, workshops, courses or seminars are called course in the following. For all mutual claims arising from or in connection with a contract between the customer and the course organizer always the terms and conditions valid at the time the contract is signed apply.

Course Descriptions

Each course is based on its individual course description on www.eeginfo.ch. It contains specific information on each course offered by us and contains information about the purpose and content of the course, as well as information about course rooms, food and accommodation.
If any details of the seminar description are in conflict with the terms and conditions, the details of the course description shall prevail. The description of each course is an integral part of these terms and conditions. Food, travel and accommodation costs are not included in the course fees, unless explicitly stated in the course description differently.

Sign-On

For mandatory registration the appropriate online registration form on www.eeginfo.ch must be completed. Alternatively, the registration form provided by the course organizer can be filled out and returned by e-mail or post. The maximum number of participants may be limited. Registrations will be considered in the order they are received and will be confirmed by the course organizer, or declined without giving any reason, in writing or by electronic means. The applicant agrees to the storage of his data under consideration of the federal data protection law and by his registration he expressly permits the course organizer to contact him in writing or by telephone.

Services and Fees

For information on the course fees, and their underlying services, please see the course description belonging to the respective course. The money must be transferred to the bank account stated on the invoice until the date of payment stated on the invoice. For later sign-ons, payment must be made until the course beginning at the latest.

Cancellation by the Course Organizer

The course organizer may, at any time, cancel a seminar with good cause (too few participants, illness of a lecturer, etc.), or may exclude individual members from participation of the seminar without naming the reason, even after confirmation of registration. In this case, the affected participants will be informed immediately and will be returned pre-paid seminar fees in full. Further claims can not be invoked, especially the cost of already booked rooms, travel expenses, lost earnings, etc.

Cancellation by the Participant

The conditions for cancellation noted on the respective registration form apply. These arrangements apply, unless a substitute participant is named and registered.

Implementation Deviation

The seminar organizer reserves the right to change dates and places of execution.

Copyright

All rights of reproduction and duplication of training materials or parts thereof are reserved by the seminar organizer. No part of the course materials may, in whole or in part, be distributed in any form, not even for use in lectures, without written consent of the course organizer. Any software that may be provided during the course may not be copied in part or entirely.

Liability

The course organizer assumes no liability for objects of any kind the customer or seminar participants brought with them to the courses. Each participant is fully liable for himself and his actions within and outside the organized event. He is fully responsible for any damage he does.

12. Applicable Law and Court of Jurisdiction
The contract entered into on the basis of these General Terms and Conditions for Sale and Delivery is subordinate to Swiss law solely.
Responsible for the clarification of litigation resulting from this contract are the courts of our registered office solely. But we are entitled to prosecute the Purchaser in his regular court of jurisdication also.

13. Final Provisions
The present General Terms and Conditions for Sale and Delivery in English are a translation of their original German version. In case of litigation only the German version shall apply.
